Sexual violence in Church: delicate question of evaluation of victims compensation

The recognition and repair commission (CRR) and the independent national recognition and repair (INSIRR) are responsible for estimating, on a case -by -case basis, the cost of the broken lives of the attacked persons. But the repair exercise is not limited to the financial aspect.

How to assess the value of a broken life? An entire existence passed to suffer, to rehash an aggression with heavy psychic consequences, sometimes identical, often different from one person to another. A year after the delivery of the independent commission on sexual abuse in the Church (CIASE), two structures set up in stride seek to answer this question every day, in an attempt to provide recognition and relieve, as much as possible, the victims. Mounted at the initiative of the Hierarchs of the Church, the Commission for Recognition and Repair (CRR) and the Independent National Recognition and Repair Instance (INSIRR) thus work to receive, listen, then estimate compensation for the victims .

“It is an impossible exercise. It is an impossible mission to repair and assess the cost of a broken life as accurately. ‘Assum to specify the lawyer Marie Derain de Vaucresson, at the head of the Inirr. Because those who address its organization or the CRR led by Antoine Garapon, a honorary magistrate, often need much more than money. Often victims of an assault which occurred several decades before, prescribed by law and therefore escaping any legal framework, many also await recognition of the evil which has been made to them and the fault committed by the Church.

In each of the two bodies, colleges made up of psychologists or even lawyers treat the cases one by one, discuss it, seeking to find the right amount or the right answer according to several criteria. At the Inirr, three axes were retained: the gravity of the facts, the response of the Church and the consequences on the person. A rating system, from the story written by the referent in accordance with the victim who validates it, then makes it possible to establish the amount which will be paid or the support which will be insured. Money comes from the solidarity and fight against miners over minor assault funds; Compensation can go up to 60,000 euros.

At CRR where the same scale has been retained, the funds come from the religious congregations from which the attackers come. Here too we take into account the nature of the facts but also the effect of “devastation” they may have had on the victim. 2> “I did not know what I had to ask”

Clearly, once all the criteria collected in one instance as in the other, rape, for example, could be considered as requiring a less important repair than a touching. Thus will be better compensated those who find themselves more assigned in their daily, financial or emotional life.
