Pension reform: thorny file of special regimes

The government plans to apply to other public services the so-called “grandfather clause” reform of the SNCF.

The subject must, in fact, be discussed, from Tuesday, November 15, with the social partners, during a “second cycle” of discussions centered on “equity and social justice”. Even before the start of exchanges relating to this theme, several scenarios are already emerging.

The executive approach corresponds to a campaign promise by Emmanuel Macron. In his program for the presidential election, he is committed to carrying out “the abolition of the main special regimes” for individuals working in certain employers – in particular RATP and companies in the electrical and gas industries (IEG ), including EDF. He had specified that the changes would take place “as we did for the SNCF”. Since 1 er 2020, the “status” of the railway company, which allows you to benefit from specific rules, in particular in matters of social protection (retirement, health insurance, disability, etc.), No longer applies to new hires. On the other hand, it continues to prevail for the staff already in place, by gradually by turning as they go away. This is called “the grandfather’s clause”.

The President of the Republic thus attacks a corpus of derogatory provisions, regularly decried: among them, there is the possibility offered to these categories of employees to claim the payment of their pension earlier than in the rest of the private and that for most officials. Thus, the average retirement age is 60 years in the IEG and slightly less than 57 years for RATP agents, according to the Ministry of Labor. State

The controversy also feeds on the subsidies that the State brings to ensure the financial balance of these regimes (for example 700 million euros, with regard to RATP). In a report submitted in July 2019, the Court of Auditors had recommended a overhaul of these singularities, because they raise “a problem of acceptability by the rest of the national community”.

A few hours before the start of the “second cycle of consultation” on pensions, Olivier Dussopt, the Minister of Labor in charge of the file, marked out the future reflection. In an interview online on Monday, On the website of the daily Les Echos , it confirms that the reform will apply to the regimes of IEG and RATP, “or even [to] that of the Banque de France”.
