NEW AGGRAVATING CIRCUMSTANCE IN CRIMINAL CODE: USING IT TECHNOLOGIES

Government Commission led by Minister of Internal Affairs Vladimir Kolokoltsev is proposing amendments to the Criminal Code of the Russian Federation to include the use of IT technologies as aggravating circumstances in crimes.

An order has been issued to the Investigative Committee of the Russian Federation to collaborate with the Ministry of the Interior and other relevant bodies to add a new aggravating circumstance to Article 63 of the Criminal Code focusing on “committing a crime using information and communication technologies.”

Furthermore, to increase accountability for crimes involving digital assets, amendments are suggested to Articles No. 104.1, No. 5 and No. 115 of the Criminal Code which would allow for the confiscation of digital currency deemed as property during criminal proceedings.

The responsible bodies have been tasked with presenting a progress report on these initiatives to the government commission by December 1, 2024.
