Parliament has definitively adopted, Wednesday, December 8, by a last unanimous vote of the Senate, a text creating two-day specific leave at the announcement of a chronic pathology or cancer in a child.

The proposed law of the member UDI Béatrice Descamps voted unanimously in March at first reading by the National Assembly was adopted without amendment by senators as part of a “niche” reserved for the centrist group.

Its main provision is the creation of a new reason for absence for family event for employees. It extends the two-day leave granted for the announcement of the occurrence of a disability in the child to the cases of chronic pathology requiring a therapeutic learning, such as diabetes, or cancer.

Like other holidays for family event, it would be the responsibility of the employer. A decree should specify the list of affected chronic pathologies. For civil servants, a special absence authorization will be allowed in the same cases.

The text also includes measures concerning school, to strengthen exchanges between the parents of a sick child and the educational team and improve teacher training about chronic pathologies.

“Two days, it’s a little to cash the shock”

“When the verdict falls, everything collapses,” said Senator LR of the Alpes-Maritimes Alexandra Borchio FONTIMP. “Two days, it’s a little to cash the shock,” she said, saying that “this bill constitutes a starting point and not the culmination of a fully protective legal framework”.

The senator PS of the Upper Garonne Emilienne Pourtiol greeted “an emergency measure, a shock absorber to the shock of the announcement”, but regretted that only two days are granted, while a marriage opens the Right to four days of holidays.

“We will be very attentive to what no serious pathology is forgotten. Forgot one of the chronic pathologies, it is neglecting some families, it is neglecting the child carrying the disease,” warned The elected centrist of Bouches-du-Rhône Brigitte must.

This is the second text adopted by Parliament in one month to improve the accompaniment of sick children, with the device allowing parents of children suffering from a serious pathology to stay longer on their side.

For the Secretary of State for Priority Education Nathalie Elimas, these texts prove that “we are all more than ever mobilized to combat inequalities, to support the most fragile, our sick children and of course their families “.
