Russia’s Providers Banned from Monopolizing MKD Internet Market

The State Duma of the Russian Federation has officially passed a bill allowing for the free placement of communication networks in apartment buildings and providing access to internet providers. The bill introduces amendments to the Law “On Communications” and the Housing Code of the Russian Federation.

Under the new regulations, communication operators can install their networks in common areas of residential buildings with the agreement of any owner or tenant without the need for a general meeting decision. This eliminates the previous requirement of approval by at least two-thirds of the owners at a general meeting for equipment installation. However, a decision by at least two-thirds of owners is still necessary for equipment dismantling.

Furthermore, the Law “On Communications” specifies that no fees should be charged for the use of common property for communication networks in apartment buildings. Providers will also be held accountable for any violations of fire safety regulations or other building operation norms resulting from their work, and will be liable for any damages caused to the property.

The interaction between providers and management companies during the installation, operation, and dismantling of networks in common areas will be governed by regulations set by state authorities in the housing sector. These regulations will outline procedures for design approval, installation, dismantling, and access to common property, as well as guidelines for addressing damages caused during the process.

The new norms will take effect upon official publication of the law, and existing providers must update their equipment to comply with the new requirements within a year. Additionally, the Government has four months to establish detailed implementation regulations once the law is in effect.

The bill’s proponents highlight that the legislation aims to promote citizens’ freedom to choose an internet provider and aims to reduce corruption in the installation process of communication equipment in apartment buildings.
