Rules for prohibition of cross -border transmission of personal data are defined

The Government of the Russian Federation in a published resolution approved the rules for the ban on cross -border transfer of personal data. According to the document, the decision on the prohibition or restriction of cross -border transfer of personal data (PDN) is made by Roskomnadzor on the basis of the received instructions from the federal executive bodies.

Only managers and deputies of the supervisory authority can make decisions on the prohibition or restriction. The deadline for making a decision is 5 days from the date of receipt of submission from the executive authorities.

The indication of the luxury is mandatory for operators to carry out cross -border transmission of personal data. In turn, operators can send a request for a restriction that will be considered within 10 days. The government decree comes into force on March 1, 2023.

cross -border transfer of personal data – the transfer of personal data to the territory of a foreign state to an authority, an individual or legal entity, which provides adequate protection of the rights of personal data subjects (Article 3, Article 12 of the Law on Personal Data).
