The Council of State announced, Tuesday, May 17, that a postponement of the entry into force of the technical control of two-wheelers beyond 1 er October 2022 “for the oldest vehicles “was” not justified “.

Imposed by a directive of the European Union (EU), this biennual control had been established from January 2023 by a decree published on August 11, 2021 in the Official Journal. But the announcement of this measure at the heart of the summer had caused the dispute of the biker federations. The next day, the government had flipped, announcing its suspension “until further notice”, at the request of the President of the Republic. It is this decree that the Council of State suspended.

This new technical control had to concern all motorized vehicles at two, three and four wheels and cars without a license to fight against accidents and pollution. Emmanuel Macron had defended this decision by the desire not to “add constraints” to the French, when they already underwent the health crisis full whip.

The breathing association, which fights against air pollution, had considered its “surprising and dangerous” suspension, according to its president, Tony Renucci, and had initiated two distinct actions: one in emergency (Suspension referral), which had been rejected, and one on the merits, against this decision, before the Council of State. For the lawyer for the association, Pierre-Eugène Burghardt, neither the President of the Republic nor the Minister for Transport had legally the jurisdiction to suspend the decree imposing this control, signed by the Prime Minister.
